The magistrate court in Mzuzu on 09th June 2015 convicted and sentenced barman Symon Nyirenda, 18 years of age, to 12 years IHL for abducting and defiling 14 year standard 5 leaner.
The sentence followed the successful prosecution of the two counts of Defilement and Abduction the barman was answering before Mzuzu Chief Resident Magistrate Texous Masoamphambe.
State Prosecutor, Cephas Chiumia told the Court on 19th May this year convict met and took the 14 year old standard five girl to his house at Mchengautuwa where he made her his wife for the whole one week.
The Court heard convict was locking up the girl in his house whenever he was going away.
The girl told the Court in her evidence that she found a chance to escape on 26th May when the convict had forgotten to lock the door when he was going to town.
By then her parents were busy searching for her in their relatives’ places.
The matter was reported to Mchengautuwa Police Unit where after referring the girl to hospital a medical report confirmed defilement.
In Court he answered two counts of Defilement and Abduction contrary to sections 138 and 135 of the Penal Code respectively.
Convict pleaded guilty and mitigated he looked for his younger brother. Passing judgement the Magistrate imposed 12 years for the first count of Defilement and 3 years for the second count of Abduction. Both sentences to run concurrently.
The convict, Symon Nyirenda comes from Chimkusa village, Traditional Authority Chindi in Mzimba District.
