The chief resident magistrate in Machinga district on Friday sentenced 38 year-old James Mwera to seven years imprisonment for killing elephants and selling ivory.
According to state prosecutor Dickens Mwambazi, police were tipped that the convict was keeping and selling ivory, a development which led the law enforcers and game officers to spy at his house.
“They managed to arrest the convict and seize six pieces of ivory weighing 42 kilograms,” he said.
Mwera was charged with entering a protected area, entering a protected area with a weapon, killing protected animals, being found in possession of ivory and selling ivory without licence.
An expert on endangered species, Mailosi Zidana, valued the six pieces of ivory at 58 million kwacha and valued the three killed elephants at 105 million kwacha.
Mwambazi asked the court to hand out a stiff punishment to the convict saying cases of poaching are rampant in areas around national parks in the country.
During mitigation, the convict hoped he will be fined or be given a community service punishment since he is a breadwinner who takes care of four orphans.
Passing her judgement, chief resident magistrate Agness Patemba slapped Mwera to serve prison terms for the five offences with the aim of deterring other would-be offenders.
She sentenced him to two years for entering a protected area, two years for entering protected area with a weapon, seven years for killing protected animals, six years for possesing ivory and six years for selling ivory. The sentences will run concurently.
Mwera comes from Amidu village in the area of Traditional Authority Liwonde of Machinga District.
