Chancellor College Associate professor and head of political and administrative studies, Happy Kayuni, has warned former Malawi President Joyce Banda that she should only threaten to take President Peter Mutharika to court if she thinks she has enough evidence that he is defaming her.

The former head of state, in a statement released on December 27, threatened Mutharika that they will battle in court if he continues tarnishing her name and legacy.

She said Mutharika being a lawyer should be aware of end results of defaming her name.

“I wish to inform Malawians without fear of contradiction that all these attempts to tarnish my name and legacy are the work of President Peter Mutharika personally and the Democratic Progressive Party (DPP) government. It is unfortunate that as a lawyer he does not realize that it is immoral to abuse his immunity from prosecution by scandalizing my name. I would have wished I met him in court so he can prove my guilt to the entire world,” warned Banda.

However, in an interview with Malawi24, Kayuni said that there is a possibility of truth in her claims but he advised Banda to provide evidence to prove her innocence so that she can defend her reputation.

Kayuni said Banda should have enough evidence when directly attacking Mutharika.

“It can be possible but the problem is that there is no real evidence on what she is saying and I think what is important for her  is if she thinks she is honest and there is nothing wrong on her side then there is no reason why she should be afraid of the whole issue.

“In fact she should have been in Malawi clearing her name using the right procedures. I don’t know why she seems to be reacting like that when actually the allegations have nothing to do with Mutharika. She does not have enough evidence to be talking about Mutharika, and then she shouldn’t directly talk like that,” stated Kayuni.

In her statement Banda singled out allegations by cashgate convict and former principal secretary for Tourism, Mrs. Treza Namathanga Senzani who claimed that the former Malawi leader had instructed cabinet ministers to steal millions of Kwacha from their respective ministries to finance the People’s Party (PP) 2014 elections campaign.

Banda who still remains in exile challenged Mutharika that she possesses all the secret information the DPP administration is championing to have her arrested.

She said: “I am not surprised by Mrs. Senzani’s allegations because I have received information from several serving senior civil servants that they are also being pressurized by the DPP government of President Peter Mutharika to implicate me and former members of my cabinet in cashgate in the same manner Mrs. Senzani has done.”

Meanwhile, Banda has denied having had a hand in cashgate saying there was no alleged meeting to steal from government.

She further said cabinet meetings are attended not only by ministers but also principal secretaries and other technocrats who belong to different political parties.
According to Banda, with such people, no scheme to steal government money for purposes of financing one political party would have succeeded because someone is bound to raise an alarm.
