Just hours after his arrest, DPP lawmaker Christopher Mzomera Ngwira has successfully been granted bail.
The Anti Corruption Bureau, in a statement released today indicated that the Mzimba Hora member of Parliament was arrested for embezzling fundsg under the Local Development Fund (LDF).
He has paid a bail bond of K50,000.
”He is reasonably suspected to have committed an offence under Section 27 (2) of the CPA in that he used his influence as Member of Parliament for Mzimba Hola constituency to award a contract for the construction of Lukwelukwe Teacher’s House project under the LDF programme to Mr. Louis Mtonga of Taonga Shopping Centre in Mzimba when the duty do so is with the Project Management Committee.”
The statement adds”Christopher Mzomera Ngwira is reasonably suspected to have committed an offence
under Section 271 (2) (e) of the Penal Code in that he on 2nd August 2010 at NBS branch in Mzimba, converted for his own use money amounting to K650, 000.00 meant for Lukwelukwe Teacher’s House Project under the LDF programme.”

Sec 42 (2) (e ) of the constitution of the Republic of Malawi stipulate that every detained person has the right to be released from detention, with or without bail unless the interests of justice require otherwise!
But that right is not absolute, bail is granted based on descretion of the court or based on circumstances surounding the case. Read carefuly that section.

@ Brighton let me agree with you that bail is granted based on descretion of the court! Well am also of the view that mzimba magistrate court has granted bail to mzomera according to its discretion,so I don’t see any problem here,that bail has condition which will complel the accused person to appear before court for the proceedings of the case, mind u the fact that mzomera has been granted court does not mean that its the end of the case, but its just one of his right that he should attend trial while coming from home and bail should not be denied to accused person as a pre judgment as the Law says that every accused person presumed to be innocent until proven guilty by a competent court, I thank you!
