No bail for Ralph Kasambara

Malawi’s ex Minister of Justice Ralph Kasambara who is the co-accused in the conspiracy to murder former budget director in the ministry of finance, Paul Mphwiyo, has had an appeal against his bail revocation thrown out.

The Supreme Court of Appeal was on Friday the 20th of November involved in a hearing of the appeal made by Kasambara who is being represented by lawyer Modecai Msiska.

Kasambara’s bail was revoked by High Court Judge Michael Mtambo on 23 September 2015 on grounds that he was trying to employ tactics that have potential to delay the whole case.

Contrary to this, the former attorney general opted for a bail on health grounds. Kasambara’s lawyer laid out six grounds for his client to be released on bail but Supreme Court of Appeal Judge Rezine Mzikamanda dismissed them.

However, the accused person’s legal team has faulted the two judicial structures for not considering their client. They argue that it is everyone’s right to apply for bail and get an unquestionable and favorable consideration.

The ruling means Kasambara whose current health state calls for medical attention, will continue to stay behind bars throughout the hearing of the murder case.
