The Nkhunga First Grade magistrate court in Nkhotakota has sentenced a student from Nkhotakota College of Education in the district to two years in prison for stealing from fellow students.

The convict, who asked for leniency because her mother is a prostitute, has been jailed for stealing a handset and a laptop bag.

CourtAccording to Nkhotakota Police Public Relations Officer Sub Inspector Williams Kaponda, the student, Shida Kambalo, went to the house of her classmate Owen Chunga and stole a Nokia X2 and a Vico.

Later, the 19 year-old stole a laptop bag from another student.

Police arrested the girl after the students found her with the items.

In mitigation, Kaombe said her mother who is a prostitute dumped her when she was a baby while her father ran away before she was born and that is why she started stealing.

However, Nkhunga Magistrate Buleya did not take the complaints into account and he sentenced the girl to two years imprisonment as a warning to would be offenders.

Kaombe hails from Chilabo village, Traditional Authority Kanyenda in Nkhotakota.

  2. There we again! Deterrent sentence which means the sentence is over and above the facts of the crime. Simply put, it is an unjust sentence for the good of the imaginary thieves. In this, what are the aggravating facts for her to be the experimental pig? The items were retrieved , she is first offender, coming from a badly broken backgr9und, she should have been given at most a suspended sentence. I have hope that the high Court will review the case in favour of the poor girl.

  10. the mitigation tells it all she might have stolen chifukwa chosoweka or kutengera kwamakolo but being the first offer i feel the magrst would have applied liniency however we dont know what the learned judge saw in the minor during cross examinations chilipo i think

  11. That tells it. The court should suspend the sentence to allow her continue with her studies. The magistrate needed to be in her shoes though stealing has no excuse before the law. The girl needs to get on with her studies to save her family one day when she gets a job. This sentence has killed her dream of becoming some body in the society one day. Mwalakwa.
