Professor Garton Kamchedzera says more needs to be done.

Chancellor College law professor Garton Kamchedzera says government can get back the money looted during the infamous cashgate scandal by forcing the looters to pay back through a trust.

Kamchedzera, said this during a public lecture organised by Malawi Law Society.

He said that a constructive trust is a situation whereby a person who has stolen public resources is declared trustee of the trust and is ordered to transfer the money to the trust.

“Constructive trust is used if somebody has misused public resources and has benefits. The law can declare the person as trustee then all the money can be recovered,” said Kamchedzera.

However, recent reports shows that government has managed to recover 300 million Kwacha from the 24 billion Kwacha that was plundered in the cashgate scandal.
