Nkhotakota first grade magistrate court has sentenced a 42 year-old Malawian man identified as Justin Moffat to 12 years in prison for defiling a 12 year-old girl in the district.
The court was told by Police Prosecutor Sergeant Cedric Cosmas that the defiler left his bedroom and enticed the young girl at the sitting room where she was sleeping before taking her to a nearby bush where he repeatedly defiled her.
The convict’s wife then discovered that her husband was missing in the room and when she reached the sitting room, she also noticed that the girl was missing too. She alerted her neighbours but in the process, the two returned to the house where the victim disclosed what Moffat had done to her.
The wife reported the matter to the police who arrested the convict and placed a defilement charge which is contrary to section 138 of the penal code.
During the hearing session, Moffat denied all the charges levelled against him but the prosecuting team brought forward four witnesses who testified against him.
Magistrate Fred Juma in his ruling sentenced Moffat to 12 years imprisonment with hard labour even though he pleaded with the court for leniency saying he was a first offender and that he has a family to look after.
“You could have thought about it before committing the crime. Did you forget that you left your wife behind before defiling the young girl?
“I therefore sentence you to 12 years imprisonment with hard labour,” said the magistrate.
The convict hails from Chikunichoola Village in the area of Traditional Authority Mphonde in the same district.
