The fate of five senior Malawi Defence Force (MDF) generals remains uncertain after the Supreme Court of Appeal suspended a High Court decision that had stopped their redeployment to civilian institutions.
The Supreme Court granted an application by Attorney General Frank Mbeta to stay the High Court judgment pending further proceedings, allowing the disputed redeployment decision to remain on hold until the appeal is determined
In a ruling delivered by a panel of judges led by Chief Justice Rizine Mzikamanda, the court ordered that the implementation of the High Court decision be suspended pending the hearing and determination of the State’s appeal.
The decision means that the redeployment order issued by Secretary to the President and Cabinet (SPC), Justin Saidi, remains in effect until the Supreme Court concludes the appeal process.
The court stated that, although it was not making any determination on the merits of the appeal, it was satisfied that preserving the status quo was necessary until the matter is fully adjudicated.
Attorney General Frank Mbeta argued that implementing the High Court ruling would present practical challenges, noting that the positions previously held by the affected officers have already been filled in accordance with military appointment procedures.
Consequently, the Supreme Court granted the government’s application for a stay of execution, meaning the five generals will not return to their former positions pending the outcome of the appeal.
