Malawi Law Society has applied to join a judicial review case challenging an injunction that has blocked Parliament from forming joint committees to investigate government operations.
The society says it intends to participate in the case as a friend of the court, arguing that the matter raises fundamental questions of constitutional and administrative law.
Malawi Law Society president Davis Njobvu says the case touches on the constitutional principle of separation of powers among state institutions.
Njobvu says the society is not taking sides in the dispute, but wants to ensure that constitutional principles are upheld in the interest of Malawians.
The injunction was obtained by Malawian citizen Austin Mkoka and prevents Speaker of Parliament Sameer Suleiman from proceeding with the formation of the 12 committees.
The society’s intervention is expected to provide the court with legal perspectives on the constitutional issues surrounding Parliament’s powers to scrutinise government operations.
