The High Court in Lilongwe has granted an interlocutory injunction restraining attempts to suspend Bwaila Constituency Chairperson Frackson Chitheka Banda amid an escalating dispute involving the Malawi Congress Party (MCP).

According to the court order dated May 11, 2026, the injunction bars Patrick Zebron Chilondola and any individuals acting on his behalf from enforcing or implementing the suspension of Banda from his position as constituency chairperson pending full determination of the matter before the court.

The order further restrains the Malawi Congress Party from recognising, ratifying, or acting upon the suspension decision in any manner until the court delivers a final ruling or issues further directions.

The ruling was issued by the High Court of Malawi, Lilongwe District Registry Civil Division, following an application filed by Banda through his legal representatives, Adrian & Company.

Court documents indicate that the application was heard on May 11, 2026, with the presiding judge considering sworn statements submitted by the claimant before granting the temporary relief.

The court has since directed the claimant to commence inter-partes proceedings within 14 days as the matter progresses toward a full trial.

In the order, the court also warned the defendants that failure to comply with the injunction could result in contempt proceedings, including possible committal and enforcement measures aimed at compelling obedience to the court directive.

The legal challenge adds to growing tensions within the MCP at the constituency level, where internal disputes and leadership wrangles continue to surface ahead of key political processes.
