The Senior Resident Magistrates Court in Zomba has denied bail to Senior Chief Malemia, who is accused of engaging in sexual relations with a girl under the age of 18 and helping her terminate a pregnancy.

During the proceedings, the court heard testimony from the first state witness, the girl’s father.

He told the court that he was shocked upon learning of his daughter’s pregnancy and the alleged involvement of the Senior Chief, given the nature of their previous interactions.

He said he later sent a message to the chief seeking clarification about the matter.

In his ruling, Senior Resident Magistrate Elija Daniel acknowledged that while all suspects have the right to bail, the seriousness of the charges and the risk of witness interference made it inappropriate to grant bail in this case.

Following the decision, defence lawyer Patrick Debwe stated that they would consult their client on whether to appeal the ruling at the High Court.

Meanwhile, Sammy Aaron, Executive Director of Action Hope Malawi and a child rights advocate, welcomed the court’s decision.

He said denying bail sends a strong message, emphasizing that such alleged actions are unacceptable, particularly for traditional leaders who are expected to protect and uphold children’s rights.
