Court denies bail to Annie Mumba in husband’s murder case

The High Court of Malawi has rejected an application by Annie Debre Mumba to be released on bail pending appeal, ruling that she must continue serving her 53-year prison sentence for the murder of her husband, Professor Peter Mumba.

In a ruling delivered on July 28, 2025, Justice Mzonde Mvula dismissed Mumba’s application, stating that her conviction was sound and that granting bail would undermine the integrity of the criminal justice system.

Mumba was convicted on October 31, 2024, of murder, contrary to Section 209 of the Penal Code. Her legal team argued that the conviction was flawed and that her appeal to the Supreme Court had a strong likelihood of success. They raised ten grounds of appeal, including claims that the evidence presented in court did not meet the threshold of proof beyond a reasonable doubt and that the 53-year custodial sentence was excessive.

The State opposed the application, stressing that bail after sentencing can only be granted under “exceptional and unusual circumstances.” Prosecutors also pointed out that Mumba had not yet served a quarter of her sentence and that her appeal lacked merit.

In his judgment, Justice Mvula ruled that Mumba had been “rightly found guilty” and that her case did not meet the conditions required for bail pending appeal. He emphasised that allowing such applications would “make a mockery of the criminal justice system” and affirmed that those convicted of serious crimes must serve their punishment.

Mumba remains incarcerated as she awaits the outcome of her appeal before the Supreme Court.
