Court rejects Jeffrey’s K70 billion compensation claim

The High Court in Lilongwe on Monday dismissed a K70 billion compensation claim by Democratic Progressive Party (DPP) Secretary General Grezelder Jeffrey and three others.

The four wanted government to compensate them after they were arrested over a K187 million corruption case but were acquitted by the courts in 2011.

They are Jeffrey, Brian Kachingwe, Agnes Kaphikire representing late Philip Kaphikire and Tadala Chakhaza representing late Brighton Chakhaza.

Jeffrey and Kachingwe sued the Bureau for malicious prosecution, false imprisonment, defamation, breach of contract and loss of business with legal costs while Kaphikire and Chakhaza sued the Bureau for malicious prosecution, false imprisonment and loss of dependency with legal costs.

Judge Charles Mkandawire on Monday dismissed all the claims with costs.

“The ACB has successfully, defended the case and prevented the loss of tax payers’ money in excess of MK50 billion through the claims for compensation,” said ACB Senior Public Relations Officer Egrita M. Ndala.

Last year, ACB director General Reyneck Matemba promised to fight the claim. He noted that some government officials failed to make the right decisions and that is why the government was being sued.

“ACB did its best to take the matter to court. But there were some officers and offices in the public sector that made the decisions causing us the problems now,” he said.
