Man fined K350, 000 over medical drugs

Mangochi first grade magistrate court on Monday ordered a 65 year-old man to pay a fine of K300,000 for being found in possession of medical drugs.

Prosecutor Sub-inspector Maxwell Mwaluka told court that on December 1, the accused person, Levison Mayenda, was arrested after being found selling assorted medical drugs worth half a million kwacha without proper documents at Mtanga Trading Centre in Mangochi district.

CourtMwaluka further said that the Police who were together with Ministry of Health officials confiscated the drugs which among them were Panado, Aspirin Quinine, and other drugs.

Mayenda was charged with being found in possession of medical drugs without licence contrary to section 45 as read with section 65 of Pharmacy Medicines and Poisons Act.

The prosecutor reminded the court that in September 2016, the accused person also committed the same offence.

The suspect pleaded guilty to the offence and in his mitigation he asked the court to be lenient since he is of old age and also a bread winner to his extended family.

When passing judgement, first grade magistrate Ronald M’bwana said that although the accused person voluntarily pleaded guilty to the offence, he deserved a stiff punishment as this is the second time and this means that he hasn’t learnt a lesson.

M’bwana also advised Mayenda to stop such behavior in order to be a good example to the youth. He then ordered him to pay a fine of K300, 000 or in default to go to prison for three years.

Magistrate M’bwana also warned the accused person that he will be sent straight to prison in future if he commits the offence.

Mayenda hails from Mtanga village, Traditional Authority Chimwala in Mangochi district.
