Rapist jailed for 14 years
A court in Nkhatabay has sentenced a 28 year-old man to 14 years in jail for raping a 13 year-old girl.
Police have identified the convict as Aubrey Chitsulo Mbawa.
State prosecutor Keston Chiona told the jam-packed court that the convict raped the girl on 31st August 2016 at Mpamba area in the district.
When the matter was brought to police’s attention, officers took the victim to Mpamba Health Centre where a medical examination confirmed that the girl had been raped.
The suspect was later arrested and charged with defilement.
When he first appeared before Nkhatabay FGM court, Mbawa pleaded not guilty to the charge and this prompted the state to parade three witnesses in a bid to prove their case.
On Friday, the suspect was found guilty and in mitigation he asked for court’s leniency since he looks after his old mother. The convict also asked the court not to send him to prison saying doing so would mean that he won’t be able to communicate with his relations who are in Thyolo.
First Grade Magistrate Anthony Banda when passing judgement first told the court that the offence the convict committed is a serious one which is punishable by life imprisonment. Magistrate Banda also said that young girls are mostly vulnerable and needs protection from the courts.
The magistrate added that cases of sexual abuse are on the increase in the district and as a measure to curb the rise, offenders deserve to be punished severely. He then sentenced the convict to 14 years in prison.
Mbawa comes from Ngamwani village, T/A Kapichi in Thyolo district.
