The Nsanje first grade magistrate court has discharged hyena Eric Aniva‘s accomplice, Theniford Jampa, Malawi24 can report.
Aniva who is infected with HIV and has over the past years been paid to sleep with young girls in Nsanje district, was arrested on President Mutharika’s order.
This is after the court said the state claims to have no substantial evidence to prove their case against him.
Jampa 65 who hails from Nthole Village in the area of Chief Chimombo charged with a holding charge of prohibition of harmful practices under section 5 sub sections 1-2 of Gender Equality Act of 2013 which he pleaded not guilty in his first appearance in court last week.
Friday, when the two appeared before the court, however the state prosecutor identified as Nanchikwe, asked the court to discharge Jampa as currently they have no substantial evidence to prove their case against him.
Immediately, Magistrate Anderson Masanjala ordered his Jampa’s acquittal: “Your case has been discharged and now you are a free man.”
On Aniva’s turn, the sate which was represented by a Nanchidwe, asked the court to adjourn the case as investigations are still underway and allow Aniva to remain on remand as more people have interest in to the case.
However, Aniva applied for a bail but the court denied him. Masanjala said he cannot give him a bail as lawyer Mandala Mambulasa under Malawi Law Society have shown interest to represent Aniva and his accomplices.
“Therefore, it is wise for Aniva to remain on remand so that he can find no problems in meeting or communicating with the lawyers wishing to represent him.
The state also brought in Vito Nkhambala, an adult, hails from Makwiza Village in the area of Traditional authority Ndamera appeared before the court for the first time with a similar charge of Aniva of prohibition of harmful practices. Nkhambala pleaded guilty.
“I plead guilty to the charge but it was in the past which I was forced to do it,” said Nkhambala. Both cases have been adjourned to August 15 2016.
