Teenager arrested for raping girlfriend in Mzuzu

Police in Mzuzu city are keeping in custody 18 year old Stranger Banda for raping a 14 year old whom he says is his girlfriend.

According to deputy public relations officer for Mzuzu police Cecilia Mfune, the victim who is 14years old, has been in a love affair with the suspect for sometime, she lives with her parents and the suspect lives with his brother and they were neighbours at hilltop area in Mzuzu.

On 7th June 2016 the suspect took advantage of the fact that the girl’s parents had gone to Nkhatabay where they were not to return until late.

RapeDuring the night, the accused called the girl into his room and they slept on the same bed, in the middle of the night they had sexual intercourse but when she returned home in the morning she found her parents had returned and when she was asked where she slept she revealed and narrated about the sex encounter.

The matter was reported to Mchengautuwa Police unit and the suspect was arrested.

Mfune said the victim is a minor of 14 years old and was defiled by a 18 year old man who was supposed to protect and defend her from any abuse.

In a related development, Mzuzu police are keeping in custody a 29 year old Joseph Goman Banda for allegedly defiling a 9 year old girl.

Mfune told Malawi24 that on 15 June at around 10:00am the accused met the victim when she was playing with her friends at Lupaso in Mzuzu. He convinced her and dragged her into his house where he defiled her. After that he gave her a k100 note.

On that particular time her parents were looking for her and when she returned home she narrated everything to them.

With the help of the members of the community they managed to take the accused to Luwinga Police unit where he was arrested, the victim was referred to Mzuzu Central Hospital where it was confirmed that she was defiled.

Both suspects were cautioned and admitted to the charge where they will appear in court soon to answer a case of defilement contrary to section 138 of the penal code.

Joseph Goman Banda, 29 years hails from Diwala village Traditional Authority Kawamba in Kasungu District and Stranger Banda, 18 years old hails from Betala Village, Traditional Authority Mwehenga in Rumphi District.

  14. Justice has to run its course here. As far as the law is concerned, the girl is a minor, and the accused has indeed committed defilement. It’s of little or no use to say the girl consented. She is an age where she can not make decisions of that magnitude by herself. She was indeed taken advantage of by the accused, and he should be punished for it. He, as an adult, was to have the victims’s interest at heart.

  21. Hey pple of my country we need to know our laws. Sleeping with a girl/boy under age is statutory rape even yo girlfriend. Dont blame the police, blame the law. Acording to law the girl is minor, she can accept anything because she is not mature enough to make a decision on her own. Some of u u are just saying if this was going to happen to your daughter, u were not going to talk that way. That is future of the nation. That is also a case of child abuse. Our law says u can ,drive, drink alchol, vote,employed and arrested only at the age of 18. So stop talking things that we don’t know. Let justice run its course.

    3. Brian kodi makolo amunyamata anatani after they heard that the boy was arrested? U need to know that Malawi do not have birth certificates or identity document (apart 4rm voters i d.) How can u testify the age of a person? Ok if the boy was arrested, 4rm my side i was going to sue ministry of police for not compile with child act protection. And the case was not even going to court I am not a policeman but a law expert. I know our laws.
