A 42 year-old man on Friday raped his 16 year-old daughter but Police in Kasungu have only charged him with incest.
The man, Yohane Sato, forced himself on the child at his home in Mbatata village, Sub-Traditional Authority Mphomwa in Kasungu district.
The wife of the suspect, who is the step mother of the victim, caught the suspect red-handed sexually abusing his daughter and she reported the incident to Kasungu police station.
When questioned, Sato said he wanted to get rich and was advised by a witchdoctor to rape his daughter.
Police arrested Sato and surprisingly only charged the rapist with incest, an offence which is contrary to section 157 of the penal code and attracts a five-year jail term.
The police should however have also charged Sato with rape since section 132 of the Penal Code says: “Any person who has unlawful carnal knowledge of a woman or girl, without her consent, or with her consent if the consent is obtained by force or means of threats or intimidation of any kind, or by fear of bodily harm, or by means of false representations as to the nature of the act, or in the case of a married woman, by personating her husband, shall be guilty of the felony termed rape.”
The maximum sentence for rape is punishment by death.
Sato will appear in court soon when police completes their investigations. He comes from Mbatata village, sub-traditional authority Mphomwa in Kasungu district.
